"Why are you so late in raising the question as Election Commission had issued notification in January 2014?" the apex court asked the Congress.

The Gujarat unit of the Congress on Wednesday moved the Supreme Court, challenging the None of the Above, or Nota, option being introduced for the Rajya Sabha elections in the state.

Senior Congress leader, Anand Sharma, who is also deputy leader of the opposition in the Rajya Sabha, said that the EC can not introduce NOTA without a Constitutional amendment, reported India Today.

Four candidates are in the fray for three Rajya Sabha seats to which the election will take place on August 8.

The Congress has also chose to issue the whip, which means that the MLAs can only vote according to the official party line.

In a petition to the Election Commission, the Congress said use of NOTA in RS elections was contrary to the mandate of the Constitution, the Representation of People's Act, the conduct of election rules and the judgment of the Supreme Court.

The Commission has said that from January, 2014, biennial elections to Rajya Sabha covering all States and 25 by-elections to the Rajya Sabha have been held. He said, "It is now becoming a trend to blatantly misuse powers of the state". The IT officials claimed that only Shivakumar's room was raided while the other 44 MLAs were exempted from the search. Shivakumar is hosting the Congress MLAs at a resort near Bengaluru.

In the Rajya Sabha polls, the MLAs have to show their ballot paper to an authorised party agent before putting it in ballot box.

The department's director general, however, has refuted the allegations, and said that the searches were planned well in advance.

The BJP, in its memorandum to the EC, said that Nota has become an issue of debate among political parties and, therefore, there should be consensus before the use of Nota in Rajya Sabha elections. Since Congress had 57 MLAs, Patel's election appeared straight forward before the defections of six MLAs.

Adding that the decision to fly to Bengaluru was taken collectively by the legislators, the party said its leaders were being regularly threatened by the BJP.
