Ninth Australian MP quits over dual citizenship issue

South Australian senator Skye Kakoschke-Moore has announced she will resign from the Senate after she discovered she obtained British citizenship through her mother.

Senator Kakoschke-Moore told a press conference on Wednesday she had received confirmation she had inherited British citizenship through her mother.

When the citizenship disclosure regime was announced earlier this month, she chose to check with authorities.

The UK Home Office advised her of her status last week, which was confirmed by a UK-based barrister who specialises in citizenship law on Tuesday night.

Her mother obtained British citizenship when she was born in Singapore and retained it when Singapore got independence in 1963 because her father was born in the UK.

She is the third member of NXT to come under a citizenship cloud.

"Their advice was extremely surprising to me".

Her leader, former senator Nick Xenophon, was one of the so-called Citizenship Seven to front the High Court this year over dual citizenship issues, but was cleared by the court over potentially being entitled to British citizenship rights via Cyprus.

Mr Xenophon has sought legal advice regarding the senator's replacement.

He said Senator Kakoschke-Moore would be referred to the High Court, which would decide how she would be replaced. "We had no reason to doubt that this advice was incorrect".

An Australian senator who is British by descent has become the ninth lawmaker to leave Parliament over a 116-year-old constitutional ban on dual nationals running for office that threatens to bring down the government.

Another NXT parliamentarian, Rebekha Sharkie, has also faced questions about her eligibility for Parliament, as she was born in England, The SMH noted.

"I think the situation is I expect that by December 4, when all the declarations will be made public, I expect that Skye will not be alone, many others will be caught up under section 44.1 of the constitution", he said.

"This will not be the end of my political career".
