The man charged in the death of 3-year-old Mariah Woods was in court for the first time Monday morning.

Her mother, Kristy Woods, told authorities that she last saw her daughter around 11:00 p.m. on November 26 when she put her to bed. A police dive team discovered Mariah's remains in a creek. The medical examiner's office will confirm an identity.

Arrest warrants obtained by WNCN report Kimrey, who was Wood's mom's live-in boyfriend, obstructed justice by, "removing Mariah Woods' body from the scene of her death and did hide Mariah Woods' death and body, knowing that Mariah Woods died from unnatural causes. The defendant acted with deceit and intent to fraud".

Kimrey was taken into custody on Friday, the Federal Bureau of Investigation and the Onslow County Sheriff's Office said in a statement.

Woods said she put her daughter to bed at around 11 p.m. on Sunday, and said her boyfriend saw the girl about an hour later when the child got up and he had told her to go back to bed, WRAL, an NBC affiliate in Raleigh, North Carolina, reported.

Once again, Lewis (15 carries for 92 yards) and Burkhead (12 carries for 78 yards and two touchdowns) could not be stopped. He's also second on the team with three rushing TDs (also a career best), to go along with one kickoff return for a score.

Warrants released by the Sheriff's Office say that Kimery "allegedly knowingly concealed the unnatural death of Mariah Woods, and secretly hid the child's body". Her disappearance set off a widespread, almost week-long search.

Kimrey charges include concealment of a death and obstruction of justice.

State arrest records show that Kimrey had previously been charged with larceny, assault, and drunk and disorderly conduct. "We have recovered what we believe are the remains of little Mariah Woods".

"Someone just walked right up in there, grabbed the 3-year-old out of the bed and she didn't cry, she didn't scream?"

Neither the defense nor the prosecution moved to alter Kimrey's bond, which was set by a magistrate at $1,010,000. He is believed to be one of the last people to have seen the little girl, who was reported missing Monday. "The arrest warrants are public record and the records speaks for themselves. The focus of this investigation has changed from a missing child to a homicide case".
