France Moves to Make Its Age of Consent 15 Years Old

The change is part of a wider law "against sexist and sexual violence" that will be presented to the council of ministers on March 21.

However, if the adult in question is to be charged with rape, the prosecutors must prove that the sex was forced.

The French government has announced plans to toughen the existing regulations following public uproar about cases where men managed to elude rape charges for sex with 11-year-olds.

It would be the first such law in France, which now does not have a rule saying a child under a certain age is considered incapable of consenting to sex.

Equality Minister Marlene Schiappa said the government "has chose to set the age at 15", after consultations with the public and an expert panel.

Sentences are the same for sexual assaults of minors and non-minors, but rape convictions carry much harsher punishments.

There had been some debate as to whether to set France's new consent threshold at 13 years or 15 years, but the latter was chosen after input from experts.

It had been discussing whether to set the age as 13 or 15, which is what groups fighting violence against children had campaigned for. In addressing rape culture, she told CNN, "We want to fix an age in the law below which it's always forbidden to have sex with children, with young girls".

Last year, a 30-year-old man escaped rape charges after a court found that his 11-year-old victim had not been subjected to "constraint, threat, violence or surprise" (The Guardian).

In the United Kingdom there are also additional laws stating that children under the age of 13 can never consent to sexual activity.

In another case involving an 11-year-old girl, a 28-year-old man had faced charges of sexual relations with a minor, rather than rape - a decision that angered the girl's family.

Once implemented it will criminalize any sexual conduct with any minor under that age.

Schiappa told reporters she was "very glad" that the government made a decision to formalize the age of consent, a move that she hopes will combat the prevalence of rape culture in France.

French President Emmanuel Macron also said he favors setting the limit at 15 years.
